OnePlanet sets protecting your privacy as the utmost priority. This Privacy Policy describes how OnePlanet (“we” or “us”) collects, uses, and shares your information collected in the course of your use of our website at https://oneplanetnft.io (the “Website”) and online services (collectively, the “Service”).

Definitions

- Creator: The creator (minter) of the NFT Collection.

- Information: Information or data about a natural person identified or identifiable by one or more factors specific to physical, physiological, genetic, mental, economic, cultural, or social identity, including but not limited to device IP, Internet identifier and information collected through cookies and other similar technology.

- NFT: A non-fungible token or similar digital item implemented on a blockchain, which uses smart contracts to link to or otherwise be associated with certain content or data.

- User: Any natural individual that uses our Website and Service.

- Wallet Address: A unique address on the Polygon Blockchain designated to a user for storage of cryptocurrencies and/or other tokens cryptographic and non-cryptographic. Used for all transactions on the Polygon Blockchain, including our Website.

Types of Information We Collect & Why

OnePlanet currently collects and processes the minimum amount of your personal information that you voluntarily provide, for the following reasons:

- Polygon Wallet Address. We will collect your Polygon Wallet Address for your transactions within our Website and Service.

- Contact Information. If you personally contact us for feedback or any other reasons, we will collect your name and contact information such as your email address, as well as any other content included in the message.

- NFT Information. We will collect the information about your NFT project to support you with the minting and launch of your project.

- Usage information. We may collect information about how you access and use our Services, your actions on the Services, including your interactions with others on the Services, comments and posts you make in our public discussion forums, and other content you may provide.

We also receive the following information indirectly currently.

- Information Collected by Our Servers. To provide our Service and make it more useful to you, we (or a third-party service provider) collect information from you, including but not limited to, your browser type, operating system, Internet Protocol (“IP”) address, and date/time stamps, and other technology on the devices you use to access our Services.

- Cookies. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to analyze how Users interact with our Service, make improvements to our product quality, and provide Users with a more personalized experience. If you decide at any time that you no longer wish to accept Cookie from our Service, then you can instruct your browser, by changing its settings, to stop accepting Cookies. - We use the Information for the purpose of rendering the full Service available on our Website.

- We use the Information for marketing purposes, such as developing and providing promotional and advertising materials that may be useful, relevant, valuable or otherwise of interest.

Disclosure of Your Information

We may disclose your Information as described below:

- Internal. We will share your Information with entities in our group or our affiliates or associated companies.

- Third-party. OnePlanet has and will have partnerships with Creators. If a User holds an NFT of a certain Creator, we may share the User’s Wallet Address with the Creator so the Creator may provide its native services to the User. We may also share your Information with (i) our third-party services providers who provide services such as website hosting, data analysis, customer services, email delivery, auditing, and other services; (ii) credit bureaus and other third parties who provide Know Your Customer and Anti-Money Laundering services; and (iii) potential or actual acquirer, successor, or assignee as part of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in bankruptcy or similar proceedings).

- Compelled Disclosure. OnePlanet may disclose Information if we believe in good faith that such disclosure is necessary in response to a valid subpoena, court order, warrant, or similar government order, or to protect our property or rights, or those of third parties or the public at large.

Your Rights

- If you are a user in the European Economic Area or United Kingdom, you have certain rights under the respective European and UK General Data Protection Regulations (“GDPR”). These include the right to (i) request access and obtain a copy of your personal data; (ii) request rectification or erasure; (iii) object to or restrict the processing of your personal data; and (iv) request portability of your personal data. Additionally, if we have collected and processed your personal data with your consent, you have the right to withdraw your consent at any time.

- If you are a California resident, you have certain rights under the California Consumer Privacy Act (“CCPA”). These include the right to (i) request access to, details regarding, and a copy of the personal information we have collected about you and/or shared with third parties; (ii) request deletion of the personal information that we have collected about you; and (iii) the right to opt-out of sale of your personal information. As the terms are defined under the CCPA, we do not “sell” your “personal information.”

We may ask you to verify your identity, or ask for more information about your request. We will consider and act upon any above request in accordance with applicable law. We will not discriminate against you for exercising any of these rights.

- Notwithstanding the above, we cannot edit or delete any information that is stored on a blockchain, for example the Polygon blockchain, as we do not have custody or control over any blockchains. The information stored on the blockchain may include purchases, sales, and transfers related to your blockchain address and NFTs held at that address.

Protection of Your Information

You acknowledge that no data transmission over the internet is totally secure. Accordingly, we cannot warrant the security of any information which you transmit to us. That said, we do use certain physical, organizational, and technical safeguards that are designed to maintain the integrity and security of information that we collect. For instance, we have implemented administrative, technical, and physical safeguards to help prevent unauthorized access, use, or disclosure of your Personal Information. Your Personal Information is stored on secure servers and is not publicly available. We limit access of your Personal Information only to those employees or partners that need to know the Personal Information in order to achieve the purposes of processing, as described above.

You need to help us prevent unauthorized access to your account by protecting and limiting access to your account appropriately (for example, by logging out after you have finished accessing your account). You will be solely responsible for keeping your account against any unauthorized use. While we seek to protect your information to ensure that it is kept confidential, we cannot absolutely guarantee its security. However, we do not store any passwords as an added layer of security.

No Use of Services by Minors

The Service is not directed to individuals under the age of eighteen (18), and we request that you do not provide personal information through the Services if you are under 18.
